Why Erin Andrews is suing to try to know who has the video of her naked? Not even illegal? I did roam heard that Erin Andrews has filmed some hotel room naked. Why is she trying to sue? Theres no law prohibits video without permission. The Constitution expressly doesn't give everyone the right to privacy. Most people think that it does, but it doesn't. There are some aspects of privacy, which are derived in the third and the fourth amendment to the Constitution. But these changes only to protect people from having soldiers quartered in your home or to protect against unlawful searches and seizures without a warrant or probable cause. All this also applies to video someone without consent. The only other laws that may prohibit * * (but really dont) are state laws. Depending on where the video was shot (and we now officially know that), it could be more detailed laws on videoing without permission. As a rule, no audio, it's perfectly fine, even if they are taken with a hidden camera. Most courts in the United States as if it had such status. In most states, if you want to record audio, you need the consent of 1 of the parties to tape. In some, you need everybody. Theres really no audio in the Erin Andrews, video, save what can you hear playing on a TV, either in your room or an adjacent room. Andrews isn't so theres no call to speak and listen. Where only video is recording, it is in almost all states, except where legal, the camera in a bathroom or locker rooms. Andrews is probably in a hotel room (and are not recorded in a bathroom or dressing). It could be further argued that since they are not in their home, she is in a public place. Her lawyer tried to give the impression, as she has some legal recourse ... I do not really know how she does. Can someone please explain why they tried to pursue the charges? Nothing here is illegal, just disgusting.
